Terms of Service

These Terms of Service ("Terms") govern your use of the PlateQuest mobile application, operated by Nautilytics ("we," "us," or "our"). By downloading or using PlateQuest, you agree to these Terms. If you do not agree, do not use the app.

If you are between 13 and 18, a parent or guardian must review and agree to these Terms on your behalf.

1. Who Can Use PlateQuest

PlateQuest is a general-audience service. You must be at least 13 years old to create an account. If you are under the age of majority where you live, you represent that a parent or guardian has reviewed and agreed to these Terms.

2. Your Account

You are responsible for keeping your account credentials secure. You agree not to share your account with others or create accounts on behalf of other people. You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree to use PlateQuest only for its intended purpose — playing the license plate collecting game. You agree not to:

4. Photo Submissions

When you submit a photo through PlateQuest, you grant Nautilytics a non-exclusive, worldwide, royalty-free license — including the right to use service providers acting on our behalf — to host, store, reproduce, and process that photo in order to review and verify the plate design, to train and improve our plate-recognition model, and, if a moderator features your approved capture as a plate design's image, to display that cropped plate image within the app's shared atlas.

Deleting your account ends this license and we delete your photos as described in our Privacy Policy; versions of our recognition model trained before deletion are not affected, and a capture featured in the shared atlas may be retained unless you ask us to remove it.

You represent that you own or have the right to submit any photo you take. You agree to indemnify and hold harmless Nautilytics and its owner from claims, damages, and reasonable attorneys' fees arising out of photos you submit in violation of that representation, your breach of these Terms, or your violation of any law or the rights of a third party in connection with your use of PlateQuest.

5. Purchases and PlateQuest Pro

PlateQuest offers one optional in-app purchase: PlateQuest Pro, a one-time, non-consumable unlock — it is not a subscription and never renews. Pro unlocks additional features (such as collecting multiple plate designs per state, the specialty-plate catalog, design stats, and expanded avatar customization); the core 50-state game remains free.

Payment is charged to your Apple Account through the App Store and is subject to Apple's terms. We never receive or store your payment details. The price shown in the app at the time of purchase is the price you pay; prices may change for future purchases.

Pro is tied to the Apple Account that bought it and can be restored at no charge on any device signed into that account via Restore Purchases. Refunds are handled by Apple, not by us — request one at reportaproblem.apple.com. If Apple refunds or revokes a purchase, the features it unlocked are disabled; your free collection and state progress are never taken away.

6. Intellectual Property

PlateQuest — including its code, original graphics, design system, and the selection and arrangement of its plate catalog — is owned by Nautilytics and protected by copyright and other intellectual property laws. We grant you a personal, non-transferable, non-exclusive license to use the app on your own devices for personal, non-commercial purposes.

License plate designs shown in the app are issued by U.S. states, and the artwork, logos, and marks appearing on them belong to the issuing states and their respective owners. PlateQuest depicts them solely to identify real plate designs in a spotting game and does not claim ownership of, sponsorship by, or affiliation with any of those owners.

You may not copy, modify, distribute, sell, or create derivative works based on any part of PlateQuest without our written permission.

IP complaints: if you believe any content in PlateQuest infringes your copyright, trademark, or other rights, email platequest@nautilytics.com with the subject "IP complaint", identifying the content and the right you hold. We review complaints promptly and remove or replace content where appropriate, and we terminate repeat infringers' accounts.

DMCA notices should include the information described in 17 U.S.C. § 512(c)(3): identification of the copyrighted work, the material you believe infringes it and where it appears in PlateQuest, your contact information, and good‑faith and accuracy statements with your physical or electronic signature.

7. Disclaimer of Warranties

PlateQuest is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of bugs. Plate identification is performed by AI and human review and may not always be accurate.

Road safety: PlateQuest is meant to be played by passengers, pedestrians, and people who are safely parked. Never use the app while operating a vehicle, and always follow applicable traffic and distracted-driving laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Nautilytics and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — PlateQuest, regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising under these Terms shall not exceed $100 USD or the amount you paid us in the twelve months before the claim arose, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the limitations above may not apply to you. In that case, our liability is limited to the greatest extent permitted by applicable law.

9. Termination

We may suspend or permanently terminate your account if you violate these Terms, with or without notice. You may stop using the app and request account deletion at any time (see our Privacy Policy for deletion instructions). Sections 4, 6, 7, 8, 10, and 11 survive termination.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles.

Talk to us first. If you have a dispute with us, email platequest@nautilytics.com with the subject "Dispute" and a description of your concern. Most issues can be resolved informally — both you and we agree to try in good faith for 30 days before starting any formal proceeding.

Binding individual arbitration. Except as provided below, any dispute arising from these Terms or your use of PlateQuest that we cannot resolve informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in English. Arbitration may be conducted by videoconference or, if an in-person hearing is required, in the county where you live. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may go to court to seek an injunction protecting its intellectual property.

Class action waiver. Disputes will be resolved only on an individual basis. Neither you nor we may participate in a class action, class arbitration, or other representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — must proceed in court instead of arbitration.

Opt-out. You may opt out of this arbitration agreement by emailing platequest@nautilytics.com with the subject "Arbitration opt-out" within 30 days of first accepting these Terms. If you opt out — or where arbitration does not apply — disputes will be resolved in the state or federal courts located in Massachusetts, and both parties consent to personal jurisdiction there.

11. General

Severability: if any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will stay in full force. Entire agreement: these Terms, together with our Privacy Policy, are the entire agreement between you and Nautilytics regarding PlateQuest. Assignment: you may not assign these Terms; we may assign them in connection with a reorganization or transfer of the business (for example, to a successor company). No waiver: if we don't enforce a provision, that isn't a waiver of our right to enforce it later.

12. Changes to These Terms

We may update these Terms from time to time. We'll post the revised Terms here and update the "Last updated" date. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
